ACKNOWLEDGMENT AND ASSUMPTION OF RISK

I understand that fencing is a combat sport and a physically demanding athletic activity that involves inherent and other risks. These risks include, without limitation, contact with fencing weapons or equipment; strikes, cuts, bruises, punctures, falls, slips, collisions, and overexertion; sprains, strains, fractures, concussions, eye injuries, cardiovascular events, and other serious injuries; aggravation of pre-existing medical conditions; equipment failure or misuse; and the acts or omissions of instructors, participants, spectators, or other persons.

I understand that these risks may exist even when applicable fencing rules are followed, protective equipment is properly used, supervision is provided, and reasonable safety precautions are taken. Such risks may result in illness, medical emergency, property damage, serious bodily injury, permanent disability, or death.

I knowingly and voluntarily accept and assume all risks, whether known or unknown, inherent in or reasonably arising from my participation—or my minor child’s participation—in classes, lessons, practices, open fencing, conditioning, camps, competitions, demonstrations, and other activities conducted or sponsored by Fencing Academy of Boston. I also assume the ordinary risks associated with my own presence at the facility as a parent, guardian, guest, or spectator.

This acknowledgment does not apply to liability arising from gross negligence, reckless or intentional misconduct, or any liability that cannot lawfully be waived.

RELEASE OF LIABILITY AND COVENANT NOT TO SUE

I understand and acknowledge that participation in fencing and related training, conditioning, competitions, demonstrations, camps, and other activities involves inherent and other risks of injury, including serious bodily injury, permanent disability, paralysis, and death. These risks may arise from physical exertion, contact with fencing weapons or equipment, falls, collisions, equipment failure or misuse, facility conditions, and the actions or omissions of instructors, participants, spectators, or other persons.

To the fullest extent permitted by law, I, on behalf of myself and, if applicable, my minor child or ward, knowingly and voluntarily accept and assume all such risks. I release and discharge Fencing Academy of Boston; its owners, officers, directors, employees, coaches, instructors, agents, volunteers, contractors, sponsors, affiliates, landlords, facility owners, members, guests, and participants; and the United States Fencing Association, doing business as USA Fencing, together with each of their respective officers, directors, employees, agents, and representatives (collectively, the “Released Parties”), from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or relating to participation in Academy activities or presence at or use of Academy facilities, including claims resulting from the ordinary negligence of any Released Party.

I further agree not to bring or maintain any lawsuit or other legal proceeding against a Released Party concerning any claim released by this agreement. This release is binding upon me, my minor child or ward, and our respective heirs, estates, personal representatives, executors, administrators, successors, and assigns.

I understand that this agreement does not release claims arising from gross negligence, reckless or intentional misconduct, or any other liability that cannot lawfully be waived. If I am signing for a minor, I represent that I am the minor’s parent or legal guardian, that I have authority to sign this agreement, and that I knowingly agree to its terms on the minor’s behalf.

I HAVE READ THIS RELEASE, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, AND SIGN IT KNOWINGLY AND VOLUNTARILY.

ACKNOWLEDGMENT AND AGREEMENT TO FOLLOW THE CODE OF CONDUCT

I acknowledge that I have received, read, and understand the Fencing Academy of Boston Code of Conduct provided with or made available during registration and incorporated into this agreement by reference.

I agree to comply with the Code of Conduct at all times while participating in, attending, or otherwise being present at any class, lesson, practice, competition, camp, event, program, or facility operated or used by Fencing Academy of Boston.

If I am signing on behalf of a minor participant, I confirm that I have reviewed the Code of Conduct with the minor in a manner appropriate to the minor’s age and understanding. I accept responsibility for ensuring that the minor complies with the Code of Conduct.

I understand that a violation of the Code of Conduct may result in disciplinary action, including removal from an activity or facility, suspension, or termination of participation or membership, subject to the Academy’s applicable policies. I understand that fees may be nonrefundable following disciplinary action to the extent stated in the Academy’s written refund and disciplinary policies.

By signing below, I knowingly and voluntarily agree to these terms for myself and, if applicable, on behalf of the minor participant identified in this registration.

VOLUNTARY PHOTO, VIDEO, AND MEDIA CONSENT

I grant Fencing Academy of Boston (“Academy”) permission to photograph, record, or otherwise capture my image, voice, appearance, performance, and likeness and, if I am signing as a parent or legal guardian, those of the minor participant identified in this registration (collectively, the “Media”).

I authorize the Academy to use, reproduce, edit, display, publish, distribute, and archive the Media for legitimate Academy-related purposes, including education, instruction, publicity, promotion, advertising, fundraising, and documentation. Authorized uses may appear in print or digital materials, including brochures, newsletters, instructional materials, advertisements, news releases, presentations, websites, social-media accounts, streaming platforms, and other media now known or later developed.

I understand and agree that:

1. This consent is voluntary, and declining consent will not affect eligibility to register for or participate in Academy programs.
2. I will not receive compensation, royalties, or other payment for an authorized use of the Media.
3. I waive any right to inspect or approve the final form of materials created within the scope of this consent.
4. Once Media has been published or distributed, it may be copied, shared, or republished by third parties beyond the Academy’s control.
5. I may revoke this consent prospectively at any time by delivering written notice to the Academy. Revocation will not affect uses made before the Academy received and had a reasonable opportunity to process the notice, and the Academy will not be required to recall, destroy, or alter materials already printed, published, distributed, or archived.
6. The Academy will use reasonable efforts not to publish sensitive personal information, including a minor participant’s home address, personal telephone number, personal email address, school schedule, or precise real-time location.

To the extent permitted by law, I release the Academy and its authorized representatives from claims arising solely from uses of the Media that are consistent with this consent. This release does not authorize defamatory, unlawful, materially misleading, or otherwise unauthorized use.

If I am signing for a minor participant, I represent that I am the minor’s parent or legal guardian and have authority to provide this consent.
